In the context of spontaneous applications or applications submitted in response to open positions, the Data Controller may process: – identification and contact details; – information relating to education, qualifications and professional experience; – personal data contained in CVs, cover letters and any additional information voluntarily provided by the applicant; – special categories of personal data pursuant to Article 9 GDPR only if voluntarily provided by the applicant and insofar as permitted by applicable law.
Personal data are processed exclusively for the following purposes: – assessment of the application and management of the personnel selection and recruitment process; – scheduling and conducting interviews and related communications; – compliance with legal or regulatory obligations related to employment and labour law; – protection of the Data Controller’s rights in judicial or extrajudicial proceedings.
The processing of personal data is based on: – the performance of pre-contractual measures taken at the request of the data subject (Article 6(1)(b) GDPR); – compliance with legal obligations to which the Data Controller is subject (Article 6(1)(c) GDPR); – the legitimate interest of the Data Controller in managing and conducting recruitment activities (Article 6(1)(f) GDPR); – the data subject’s consent, where required by applicable law (Article 6(1)(a) and Article 9(2)(a) GDPR).
Personal data are processed using manual and electronic tools, in accordance with the principles of lawfulness, fairness, transparency, data minimisation and security, and by adopting appropriate technical and organisational measures to protect the data.
Personal data may be disclosed to: – authorised internal personnel of the Data Controller; – external consultants, recruitment agencies, IT and HR service providers, duly appointed as data processors pursuant to Article 28 GDPR; – competent public authorities, where required by law.
Personal data will not be disclosed or made publicly available.
Where personal data are transferred to countries outside the European Union, the Data Controller ensures that such transfers take place in compliance with Articles 44 et seq. GDPR, including the adoption of appropriate safeguards (e.g. adequacy decisions or standard contractual clauses).
Personal data relating to job applicants will be retained for a maximum period of 24 months from the date of collection, unless: – an employment relationship is established; – longer retention is required by applicable law; or – the applicant provides explicit consent for a longer retention period for future recruitment opportunities.
Applicants may exercise at any time the rights provided for in Articles 15–22 GDPR, including the right of access, rectification, erasure, restriction of processing, objection and data portability, by contacting the Data Controller.
Applicants also have the right to lodge a complaint with the competent Data Protection Authority.
The provision of personal data is voluntary; however, failure to provide the data necessary for the evaluation of the application will make it impossible for the Data Controller to consider the application.
